McKinney-Vento Homeless Assistance Act

Subtitle of VII-B of The McKinney-Vento Homeless Assistance Act authorizes the federal Education for Homeless Children and Youth (EHCY) Program and is the primary piece of federal legislation related to the education of children and youth experiencing homelessness. It was reauthorized in December 2015 by Title IX, Part A, of the Every Student Succeeds Act (ESSA).

Children and youth who lack a fixed, regular and adequate nighttime residence, including those who: 

  • Are sharing the housing of other persons (doubled up) due to loss of housing, economic hardship, or similar reason

  • Have a primary residence that is a public or private place not designed for or ordinarily used as a regular sleeping accommodation for human beings.

  • Are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings; and

  • Are migratory children living in the above circumstances.

  • Unaccompanied youth include a homeless child or youth not in the physical custody of a parent or guardian.

A Military Connected Student is a student enrolled in a school district or an open-enrollment charter school who is a dependent of a current or former member of the United States military, Texas National Guard, or reserve force in the United States military or who was a dependent of a member of the United States military, Texas National Guard, or reserve force in the United States military who was killed in the line of duty.
